Wherever the voice of truth has not reached,
thereto we will go and recite the Qur’an. I seek refuge with Allah from Satan,
the accursed. In the name of Allah,
Most Gracious, Ever Merciful. Respected viewers, from MTA Germany, we
present to you the program Hiqayat-e-Sidqo Wafa. Like our previous programmes, we are
accompanied today by our very esteemed guest, Mohtaram Muhammad Ilyas Munir Sahib, who
by the Grace of Allah, is the Murabbi-e-Silsila here in Germany. From 1984 till 1994,
you were blessed with the honour of being wrongly
imprisoned for the cause of Allah. We will continue our
conversation in this regard. Dear viewers, before we proceed
with our conversation here in the studio, it is useful to present a brief recap of
the previous programme. Let us view those.Very emotional. Huzoor’s letters
were very emotional. Upon reading them,
we would be able to persevere.
We never imagined that such lies could be spoken.
This was a case in the civil
court. It is a very normal case.
It was handed to the martial law court.Dear viewers, you have seen a few
glimpses from the previous programme. Now we will continue our
conversation. Mukarram Maulana, it was mentioned in the previous programme, what was
unique about your case was that it was presented in the martial law court and
you were taken to Multan to testify. Here I would request that you explain the
circumstances of the case, especially in court, please describe the situation
and the atmosphere that was created.Peace be upon you.
According to the military system,
there are two types of courts
that are held during martial law.
One is the court for a brief hearing
and the second is a special military court.
In the brief hearing court, a major would
hear the case , and the decision and punishment
are determined at that time. However,
the special military court sees such cases
in which the punishment
can go up to the death penalty.
And apparently, a full procedure is carried
out in that court. So, our case was presented
in the special military court number 62 in Multan,
which has three members.
One lieutenant colonel,
one Major, and the third is the magistrate,
who is taken from the civil sector.The lieutenant colonel was Munir-ur-Rehman,
who was the president of the court.
He was accompanied by Major Shehzad.
It was someone else at first but then it changed,
and Major Shehzad was appointed.Similarly, there was a magistrate.
The role of the magistrate was just a name.
The real control was under the military.From among them, the lieutenant
colonel was the one who fulfilled the real duties.
It appeared to be the same process as
the civil court. The presentation of the case,
then the defense lawyers,
and then presentation of the accused.
However, as it was from the beginning,
justice was completely annihilated.
There was no rule or law,
or anything that could bring justice.
From our side,
two lawyers were presented, which included
the late Khawaja Sarfaraz Ahmad Sahib,
who was a very competent lawyer from Sialkot.
He represented four
out of us seven accused.
The rest of the three accused were
represented by Respected Mujeeb ur Rahman Sahib.
By the Grace of Allah, both advocates,
to the best of their ability and skill,
pleaded this case. May Allah bless them!Ameen.They got pleasure from presenting
the case in court, during cross examination,
and throughout the entire
procedure. Along with them,
Mian Umar Chugtai Sahib
assisted [the case]. He was an elderly lawyer,
and also a retired PDSB, as in the
person in charge of the legal branch of police.
He was the head of our team.
He was assisted by Malik Ghulam Ahmad Sahib,
who passed away last month in Canada.
There was also Nasir Sera Sahib, Mirza Sami Sahib,
and Abdul Hafeez Sahib from
Multan. They were on the panel of advocates
that were assisting him. However,
these two, were the ones presented in court
and they did all the talking.In the beginning, you related that
the FIR consisted of many mistakes. Certainly, the advocates must have
pointed them out and presented them in court. Why did you receive punishment then?
Was the reason for that under the same multitude?Of course.If you study the case, the cross
examination and examination of the witnesses,
and the attitude of the court,
and the evidence that was presented
by both advocates in our defense; if you
read that, then even a regular person is shocked
that they altered the case in such a
way. The biggest thing about this is that
according to the methods of the
military court that they have created themselves,
if the military court decides
on a punishment less than death,
then the case only goes to the CMLA,as in the governor or the administrator of Punjab,
who confirms it.
If it is a death penalty, then the case
is sent to the chief martial administrator,
who confirms it and carries out the
penalty. Now in our case, the fundamental decision
of the court was that two
people receive the death penalty.
Hence, according to their laws,
they were required to go through the process.
Hence, they sent the file to the
martial administrator of Zone A of Punjab
to confirm the decision,
who sent it to the legal branch.
They approved the review that the
legal branch conducted and sent it back.
That review was on two full pages
and the heading was “Revision Order”.
He had made points on it in the format of A,
B, C, D, and E.
I have included a copy of that in
the book. After making those points,
he came to the conclusion that in
light of these points, this is not a case for 302.
At most,
it is a case for 304, which includes a clause
where someone can use
force to defend themselves.
And maximum
imprisonment for that is four or five years,
and that too is against one person;
that is what he affirmed.
This is a huge affirmation from
their side that they have done injustice
and have denied justice, obstructed justice. Now,
what the court did when they
received the revision order is thatthey kept the case copy or
directly sent it to General Zia-ul-Haq.
And General Zia-ul-Haq
waited until the martial law was over,
because as long as martial law was imposed,
he was bound to go through the right way.
Martial law ended on 30th December 1985,
and then he extended the court’s decision
in a way that previously where the
death sentence was given to two people,
an additional fine of 10,000
rupees was made for each person.
And previously,
where the rest of the four people
were sentenced for seven years imprisonment each,
that was extended till 25 years each.
And then this decision was
implemented. This happened on 16th February 1986.
Directly the President of Pakistan
made these changes? Is that legal in Pakistan?When someone becomes a dictator,
what remains of the law and legality?
Correct.Who would have asked
him? He was pretending to be God.
Legality is spoken about
when there is a law. In that situation,
we received his decision directly
and it had General Zia-ul-Haq’s signature.
A copy of it is published in my book.
Even though that does not happen normally;
the court which is making the
decision has their signature on it.
That is just a confirmation.Correct.This proves that he was
grinding his teeth against us personally.
And was in anger that, “I consider them
[Ahmadis] as cancer and want to eradicate them,
“instead they are getting stronger, what
is the reason?” So, this is the whole scenario.
Now, what is amusing is that when
they delivered the decision to us in the jail,
our lawyers then asked
for the file of the proceedings.
This is a lawful right of every
prisoner. When the copy was asked for,
they gave the file to us,
and in it four pages were absent from it.
Two pages were about the
revision order given by Ghulam Jilani Khan.
Which came from the Punjab level?It came from the Punjab level.
Those pages. The other two pages were of
the previous decisions
made by the military court,
which mentioned seven years imprisonment,
and which was probably decided soon after
the hearing of our case when
the martial law was still imposed.
Now they retracted those pages from
between but forgot to change the numbering.
In the numbering of that file,
there is no 56 and 57 after 55, and after 58,
There is no 59 and 60. So our lawyers said
– and we got to know about this
from other sources that a
revision order of this sort has been issued,
and we realised that those are the
pages which have been retracted from our file.
Hence,
we demanded and got those papers from them.
Now their dishonesty is evident –– At every step.There is a distance between each step.
Their dishonesty occurred at every millimetre.
So, now they tried to hide that
dishonesty. However, Allah the Exalted
created such circumstances
that they were not able to hide that.
And so,
that is how that situation –
Here I want to add for my own
understanding and for our viewers as well, you were firstly given the
punishment by the military court and then there is quite a gap until the
President of Pakistan of that time, General Zia-ul-Haq Sahib,
adds to that punishment and orders his decision. Was that a gap of a few years,
a long period? Or did occur rapidly?No. Our case hearing
was completed in June 1985.
And the first decision
was made few days after that.
When the case went to the legal branch,
there it took two, three months.
And then they gave the
revision order either in the
end of September or beginning of October. Then,
in the start of October,
they made another decision
which was not sent to the court,
rather it was sent
directly to Zia-ul-Haq.
Okay.And Zia-ul-Haq, cunningly,
ensured that the decision was not implemented,
rather he waited until the martial
law ended and so the administrative part –
the Zone administrator –
was cleared from the middle.
Then,
he directly implemented his decision.
During this whole period, the first
decision which you heard, which had mentioned the death sentence for two people,
who were those two blessed people?It was just the two of us.
It was Rana Naeemuddin Sahib and I.
Being a human,
when you heard about the order of death sentence – please focus on your memory
– and describe in detail what your thoughts were?Regarding this matter, when the
magistrate came to tell us that in the jail,
he told this to our lawyer, Nasir Sera
Sahib. I knew the condition I was in then.
Hazrat Masih Maud’s
(as) verse was on my tongue,
“If they ask for our lives,
then so be it”.
Even though we did not know that
it was about to happen, but nevertheless
I was repeating this verse. “At least some
trouble is dealt from the decision of the heart.”
So,
that magistrate told him, Nasir Sera Sahib
– who is still alive due to Allah’s
blessing and his son is also here.
And then he let me know not once but many
times about what the magistrate said about me,
that, “He was a weird prisoner,
he was given death sentence, yet he was calm,
“and I was surprised that,
what is this?” It was purely Allah’s blessing.
We had no idea what this was all about.God Almighty gave us strength
and forbearance through His blessings.
Our only concern was what
Hazrat Mirza Tahir Ahmad (rh) wrote that,
pray that in front of any non-Ahmadi,
Jama’at should not kneel, beg or cry.
That you should not fall weak.Yes. This was one desire that in any case
we should uphold Jama’at’s dignity and honour.
JazakAllah. Respected Maulana, I am very
grateful that you have given us your time and shared your
